Terms and Conditions

Last updated: September 2026

These Terms and Conditions ("Terms") govern your use of The Executive, a web application accessible at theexecutive.app (the "Service"), operated by The Executive ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

This document is a draft prepared for launch and has not yet been reviewed by a lawyer. It should not be treated as final legal advice until reviewed by qualified counsel.

1. What the Service Does

The Executive is an AI-powered advisory tool for TikTok creators. You upload screenshots of your own TikTok analytics, and the Service uses artificial intelligence (including third-party AI models such as Anthropic's Claude) to analyze the data shown in your screenshot and generate feedback, growth strategy suggestions, and related content ("Verdicts"). The Service also offers optional voice playback of Verdicts using third-party text-to-speech technology.

2. Eligibility and Accounts

You must be able to form a legally binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating an account.

3. Your Content and Consent

When you upload a screenshot of your TikTok analytics, you confirm that:

Screenshots you upload are processed to generate a response but are not permanently stored by the Service. Numeric data extracted from screenshots (such as follower counts and engagement rates) may be stored to power features like growth tracking, as described in our Privacy Policy.

4. AI-Generated Content — No Guarantee of Results

Verdicts, strategy suggestions, and all other content generated by the Service are produced by artificial intelligence and are provided for informational and educational purposes only. They do not constitute professional, financial, legal, or business advice.

5. Subscriptions and Billing

The Service offers a free trial period, currently 14 days from account creation, subject to usage limits. After the trial, continued access to full features requires a paid subscription, currently offered at $15/month (the "Executive Plan"), billed through our payment processor, Stripe.

6. Usage Limits

To manage the cost of operating the Service, we apply usage limits (including daily and trial-period token limits) to both free and paid accounts. These limits may change over time. We will make reasonable efforts to communicate significant changes to paid subscribers.

7. Account Deletion

You may request deletion of your account at any time from within the app. Upon deletion, your account is deactivated immediately and permanently purged from our systems after a retention window (currently 30 days), after which recovery is not possible. If you have an active paid subscription at the time of deletion, it will also be canceled.

8. Acceptable Use

You agree not to:

We reserve the right to suspend or terminate accounts that violate these Terms.

9. Third-Party Services

The Service relies on third-party providers, including but not limited to Anthropic (AI model processing), Inworld AI (voice synthesis), Stripe (payment processing), and Supabase (authentication). Your use of the Service is also subject to the applicable terms of these providers where relevant. We are not responsible for outages, errors, or changes caused by third-party providers outside our control.

10. Intellectual Property

The Service, including its design, branding, character ("The Executive"), and underlying technology, is owned by us and protected by applicable intellectual property laws. You retain ownership of the screenshots and data you upload. By using the Service, you grant us a limited license to process that content solely to provide the Service to you.

11. Limitation of Liability

To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will make reasonable efforts to notify active users. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
